Jakarta, 23 November 2021 – Melalui APPI, Klub Persis Solo melakukan pembayaran tunggakan gaji kepada 18 (Delapan Belas) eks-pesepakbola nya. Hal ini merupakan rentetan panjang yang pada akhirnya telah terselesaikan dengan baik. Maka dengan ini APPI mencabut Permohonan dari 18 (Delapan Belas) pemain tersebut yang telah masuk dalam proses di NDRC Indonesia.
Pada tanggal 13 Agustus 2021, setelah melalui beberapa kali korespondensi yang tidak membuahkan hasil yang diharapkan, APPI mewakili 7 (Tujuh) dari total 18 (Delapan Belas) eks-pesepakbola Klub Persis Solo, mengirimkan Permohonan gugatan terhadap klub Persis Solo melalui NDRC Indonesia, atas tunggakan gaji klub yang belum dibayarkan kepada mereka. Pada saat itu APPI hanya dapat mengajukan gugatan terhadap 7 (Tujuh) dari total 18 (Delapan Belas) Pesepakbola dikarenakan hanya 7 (Tujuh) orang tersebutlah yang memiliki salinan dari kontrak mereka dengan Klub Persis Solo. Namun Permohonan tersebut ditolak oleh NDRC Indonesia karena ketidaklengkapan dokumen.
“Apa yang kami alami menjadi pelajaran yang sangat berharga. Perjalanan kami meminta hak-hak kami menjadi sangat sulit karena Kami tidak menyimpan salinan kontrak. Kami menghimbau kepada rekan-rekan pesepakbola lainnya untuk senantiasa menyadari akan pentingnya mempelajari dan untuk menyimpan salinan kontrak kerja dengan Klub. Karena kita tidak pernah tau kapan kita akan membutuhkannya.”, Hapidin – Eks Pesepakbola Persis Solo.
Melalui upaya panjang yang dilakukan, akhirnya APPI berhasil mendapatkan seluruh salinan kontrak dari total 18 (Delapan Belas) eks-pesepakbola klub Persis Solo dan kembali melakukan permohonan pendaftaran sengketa kepada NDRC Indonesia terhadap Klub Persis Solo, pada tanggal 18 Oktober 2021 dan kemudian pada tanggal 9 November 2021, NDRC Indonesia menerima permohonan pendaftaran sengketa tersebut dan menyatakan bahwa permohonan tersebut telah memenuhi ketentuan pasal 18 Regulasi NDRC dan perkara ke-18 eks pesepakbola Klub Persis Solo tersebut telah terdaftar dengan nomor pekara 044/NDRC/XI/2021 s/d 061/NDRC/XI/2021. Pada tanggal yang sama, NDRC Indonesia juga telah menetapkan para nama-nama Majelis Arbitrase untuk memeriksa dan memutus perkara-perkara tersebut dan memberikan waktu paling lambat 5 (Lima) hari kerja kepada Klub Persis Solo untuk memberikan tanggapan akan klaim sengketa tersebut. Namun karena telah adanya penyelesaian oleh Klub Persis Solo di tengah proses yang sedang berjalan, maka APPI mencabut Permohonan tersebut dan menghentikan proses yang tengah berjalan tersebut.
“Proses pergantian manajemen klub sepakbola di Indonesia seringkali terjadi permasalahan dalam peralihan nya, aktivitas audit dan due diligence sudah harus dipraktekan agar tidak terjadi permasalahan dikemudian hari. APPI memberikan apresiasi atas pelunasan ini terhadap klub Persis Solo, dan dengan adanya pembayaran tersebut, APPI telah mencabut gugatan atas klub Persis Solo di NDRC Indonesia.”, M. Jakarta, 24 September 2021 — Through APPI, Persis Solo Club made the payment of salary arrears to their 18 (Eighteen) ex-footballers. This was a long journey that has finally been well resolved. Therefore, APPI hereby revokes the applications of the 18 (Eighteen) players that have been processed at the NDRC Indonesia.
On August 13, 2021, after several correspondences made which generate unexpected results, APPI representing 7 (seven) out of a total of 18 (Eighteen) ex-footballers of Persis Solo Club, sent a lawsuit against the Persis Solo club through NDRC Indonesia for the salary arrears that have not been paid to them. At that time APPI could only file a 7 (Seven) out of a total of 18 (Eighteen) lawsuits because only these 7 (Seven) footballers had a copy of their contract with the Club. However, the application was rejected by NDRC Indonesia due to the incompletion of documents.
“We experienced such a very valuable lesson. Our journey of asking for our rights is very difficult because We do not keep a copy of our contracts. We urge other fellow footballers to always be aware of the importance of studying and to keep your copy of the employment contract with the Club. After a long fight, APPI finally managed to get all copies of the contracts from a total of 18 (Eighteen) ex-footballers of the Persis Solo club and again submitted a dispute registration request to the NDRC Indonesia against the Persis Solo Club, on 18 October 2021. On 9 November 2021, NDRC Indonesia accepted the application, and the case for the 18 former footballers of the Persis Solo Club had been registered with case number 044/NDRC/XI/2021 to 061/ NDRC/XI/2021. On the same date, the NDRC Indonesia has also appointed the names of the Arbitration Tribunal to examine and decide on these cases and gave Persis Solo Club a maximum of 5 (five) working days to respond to the disputed claim. However, due to a settlement made by the Persis Solo Club in the middle of an ongoing process, APPI revoked the application and ask to stop the ongoing process.
