Jakarta, 15 Juli 2022 – Alex Goncalves, Pesepakbola asal Brasil akhirnya menerima pembayaran atas haknya yang tertunggak oleh Klub Persikabo setelah DRC FIFA dengan nomor Putusan Ref. Nr. FPSD-3269 tertanggal 9 November 2021 dan dikirimkan tanggal 15 November 2021 memutuskan menerima gugatan Alex. Alex menggugat karena tidak menerima keputusan sepihak dari Klub Persikabo atas SKEP PSSI No.48/SKEP/III/2020 mengenai pemberian gaji sebesar 25%. Namun meskipun DRC FIFA memutuskan menerima gugatan Alex, tidak serta merta membuat hak Alex terbayarkan. Alex justru dilaporkan kepada pihak kepolisian dan Passportnya sempat tertahan oleh pihak Imigrasi Indonesia.
Kasus ini turut menjadi perhatian dunia setelah Presiden Negara Brazil, Jair Bolsonaro, mengecam keadaan yang dialami oleh Alex. FIFA pun melalui Investigatory Chamber of the FIFA Ethics Committee turut mengawal dan menyelidiki kasus ini. Selain APPI dan FIFPRO, Alex juga mendapat perlindungan oleh Pihak Kedutaan Besar Brasil.
Awalnya APPI menjadi salah satu pihak yang diberikan kuasa oleh Alex untuk menjadi Pendamping hukum/advokat terkait dengan kasus yang Alex sedang hadapi. Namun APPI pada tanggal 21 Desember 2021 mengundurkan diri sebagai Kuasa Hukum Alex dikarenakan proses negosiasi untuk mencapai kesepakatan damai tidak dapat mengakomodir hak-hak Alex sebagai pesepakbola profesional yang telah patuh dan tunduk dengan proses hukum sesuai dengan regulasi FIFA. Dalam hal ini APPI cukup kecewa karena adanya perbedaan padangan dalam melihat suatu produk hukum yang dikeluarkan FIFA yang seharusnya untuk dipatuhi dan dijalankan oleh para stakeholder sepakbola Indonesia.
Kemudian Alex melanjutkan proses penyelesaian kesepakatan damai tersebut menggunakan Kuasa Hukum yang direkomendasikan oleh Pihak Kedutaan Besar Brasil. Disepakati bahwa Persikabo akan menarik laporan di kepolisian dengan syarat Alex juga menarik tuntutan gaji yang belum dibayarkan oleh klub Persikabo. Kesepakatan damai terwujud pada tanggal 24 Desember 2022 bertempat di kantor PSSI, Senayan, Jakarta. Pada tanggal 28 Desember 2021 Alex telah kembali ke negara nya, Brasil, dengan didampingi oleh pihak Kedutaan Besar Brasil.
Alex kembali mengirimkan surat kepada FIFA, bahwa saat proses membuat kesepakatan damai, Alex mendapat tekanan yang cukup berat yang mengharuskan ia mengambil keputusan damai tersebut. Kemudian FIFA menyatakan bahwa Putusan DRC FIFA no Ref. Nr. FPSD-3269 tetap berlaku dan meminta Persikabo dan PSSI untuk patuh dan menjalankan putusan tersebut.
“Pada tanggal 7 Juli 2022, saya telah menerima seluruh jumlah yang harus dibayar. Terima kasih kepada semua yang mendukung dan mendoakan saya, karena sampai hari itu tiba, begitu banyak hal yang terjadi. Tapi keadilan dan kebenaran selalu menang. Kepada teman-teman pesepakbola, perjuangkan hak anda sampai akhir, kita adalah pekerja yang pantas dihormati.” – Alex Goncalves
Putusan tersebut menyatakan jika tunggakan terhadap Alex belum terpenuhi maka Persikabo tidak dapat bermain dalam kompetisi Liga-1 tahun 2022/2023. Untuk itu Persikabo kini telah melunasi tunggakan terhadap Alex sehingga mereka dapat bermain dalam kompetisi Liga-1 tahun 2022/2023 yang akan dimulai pada tanggal 23 Juli 2022 mendatang. Akan hal tersebut APPI menyampaikan apresiasi terhadap klub Persikabo yang telah patuh, tunduk dan menjalankan Putusan DRC FIFA.

Persikabo Settled the Salary Arrear’s of Alex Goncalves
Jakarta, 15 July 2022 – Alex Goncalves, the Brazilian footballer finally received his payment from Persikabo Club after the DRC FIFA with Decision number Ref. Nr. FPSD-3269 dated November 9, 2021 which sent on November 15, 2021 decided to accept Alex’s lawsuit. Previously, Alex was sued by the club for not accepting a unilateral decision from the Persikabo Club on PSSI SKEP No.48/SKEP/III/2020 regarding the 25% provision of the salary. However, even though the FIFA DRC has won him the case, it didn’t necessarily pay off Alex’s rights. Instead, Alex was reported to the police and his passport was detained by the Indonesian Immigration Office.
This case also became the world’s attention after the President of Brazil, Jair Bolsonaro, criticized the situation experienced by Alex. FIFA, through the Investigatory Chamber of the FIFA Ethics Committee, also oversees and investigates this case. Apart from APPI and FIFPRO, Alex also received protection from the Embassy of Brasil in Indonesia.
Initially, APPI was one of the parties authorized by Alex to become a legal assistant/advocate related to the case that Alex was facing. However, APPI on December 21, 2022 resigned as Alex’s attorney because the negotiation process reached a peace agreement could not accommodate Alex’s rights as a professional footballer who has complied and complied with the legal process in accordance with FIFA regulations. In this case, APPI was quite disappointed because the legal product issued by FIFA should be obeyed by Indonesian football stakeholders.
Then Alex continued the process of completing the peace agreement using a lawyer recommended by the Brazilian Embassy. It was agreed that Persikabo would withdraw the report to the police on the condition that Alex also withdraw the salary demands that the Persikabo club had not paid. The peace agreement was held on December 24, 2022 at the PSSI office, Senayan, Jakarta. On December 28, 2021 Alex has returned to his country, Brazil, accompanied by the Brazilian Embassy.
After returning to Brazil, Alex sent a letter to FIFA stating that during the “peace agreement” he was on a heavy pressure that forced him to accept such peace treaty. After that, FIFA stated that the FIFA Decision Ref. Nr. FPSD-3269 was still valid and asked Persikabo to fullfil such decision.
“On July 7, 2022, I have received the entire amount due. Thank you to everyone who supported and prayed for me, because until that day came, so much had happened. But justice and truth always win. To my football friends, fight for your rights to the end, we are workers who deserve respect.” Alex Goncalves.
The decision stated that if the arrears against Alex had not been fulfilled, Persikabo could not play in the Liga-1 competition in 2022/2023. For this reason, Persikabo has now paid off the arrears against Alex so the club will be able to play in the 2022/2023 Liga-1 competition which will start on 23 July 2022. In this regard, APPI expresses its appreciation for the Persikabo club that has complied, obeyed and implemented the FIFA DRC Decision.
